Waltham District Court

Docket No. 1151-CR-000470

The client was charged with Operating a Motor Vehicle while under the influence of alcohol and Reckless Endangerment. Officers responded to a report of a car allegedly swerving in and out of its lane while traveling down a public road. Officers arrived on the scene and eventually pulled over the client’s vehicle. After the client allegedly failed a Field Sobriety Test, she was arrested and charged. Attorney Russell negotiated with prosecutors to drastically limit the client’s punishment. The client lost her license for 60 days and had to pay a small fine but avoided any other punishment. Team Russell succeeded in providing the client with the best possible outcome given the evidence against her.

Docket No. 0708-CR-002150

The client was charged with Speeding and Operating Under the Influence of Alcohol. Officers stopped the client’s car as it was allegedly speeding down a public street. The client submitted to take a field sobriety test which the officer alleged he failed. The client was arrested. Attorney Russell used his connections and experience with the District Attorney’s Office to negotiate a plea for the client. Despite the heavy evidence against the client, Attorney Russell was able to secure probation for the client, which ultimately resulted in the case being dismissed.

Docket No. 0707-CR-001370

The client was charged with Operating a Motor Vehicle with a Suspended License. The client was pulled over by Police after they had randomly run his plates to discover a suspended license. The client was arrested. Attorney Russell was appointed to the case, and using his connections at the District Attorney’s Office, was able to have the case dismissed outright. No disciplinary action was taken against the client.

The client was charged with Possession of Crack Cocaine near a school zone. Undercover officers arrested the client after conducting a sting operation in which the client sold crack to an undercover officer. Attorney Russell filed several motions with the court, including a motion to suppress evidence that Team Russell felt had not been properly admitted against the client. The motion was granted and Attorney Russell was able to secure probation for the client instead of him having to serve any jail time or pay any fines.

Docket No. 0707-CR-001373

The client was charged with breaking into a car. Officers arrived on scene to allegedly witness the client looking into a car “suspiciously”. When officers questioned the client, they were unsatisfied with his responses and arrested him after he told them he had broken into one of the cars he was looking into. Despite the statement to officers, Attorney Russell was able to convince the court that the client’s actions did not constitute a serious offense and the case was dismissed outright.

Docket No. 0612-CR-000110

The client was charged with Operating a Motor Vehicle under the Influence of Alcohol. Officers responded to a call indicating there had been a car accident. Upon arrival, the officer encountered the client. After administering a field sobriety test, the officer believed the client to be drunk and arrested her. Despite the client having submitted to a field sobriety test, Attorney Russell was able to have the case continued for a year, after which it was dismissed. Attorney Russell circumvented the prosecution’s evidence in order to achieve a favorable outcome for his client.

Docket No. 0807-CR-007255

The client was charged with Operating a Motor Vehicle with a Suspended License and Leaving the Scene of Property Damage. Police were called to the scene for an unidentified issue with a man behind the wheel of an SUV. Upon arrival, Officers met with the client who had extensive damage to the front of his car. The client was confused and could not tell the Police what happened. After further inspection officers discovered an overturned fire hydrant in the middle of the street with shards of paint supposedly from the client’s vehicle next to it. Police also discovered that the client’s license had been suspended and that he had outstanding warrants against him. The client was arrested. Despite the overwhelming evidence against the client, Attorney Russell was able to have all charges against the client dismissed.

Docket No. 0707-CR-008100

The client was charged with stabbing someone. The client allegedly followed the victim home and assaulted him with a knife, stabbing him in the torso. Attorney Russell was assigned to the case and immediately contacted the District Attorney to discuss a possible plea bargain to reduce the client’s punishment. However, the victim did not show up at any pre trial hearings and the case was subsequently dismissed.

Docket No. 0807-CR-006364

The client was charged with Failing to Stop for Police, Crossing over into an oncoming lane of traffic, Failing to Signal and Speeding. Officers allegedly witnessed the client speeding in his vehicle. The client allegedly failed to stop immediately upon the Police Officer’s attempt to pull him over. Officers also allegedly observed suspicious activity from the occupants of the vehicle. After pulling him over, the officers arrested the client. Attorney Russell was able to have all charges dismissed after speaking with prosecutors.

Docket No. 0807-CR-003574

The client was charged with Disorderly Conduct and Disturbing the Peace. Officers responded to a call alleging loud music being played at a private residence. Upon arrival, officers encountered the client having an argument with someone outside her house. The client was yelling, and refused to cooperate with officer’s attempts to alleviate the situation. After repeated failed attempts by Police to calm the client down, she was arrested. Through negotiations with prosecutors, Attorney Russell was able to have the Disorderly Conduct charge dismissed outright, and secured probation for the client on the second charge.

Docket No. 0951-CR-000682

The client was charged with Operating Under the Influence of alcohol. A Police Officer allegedly observed the client driving erratically and proceeded to pull him over. The client agreed to take a breathalyzer and field sobriety test. In the officer’s opinion the client did not pass the tests, and was arrested. Despite the documented evidence against the client, Attorney Russell was able to continue the case for a year, at the end of which, the matter was dismissed. The client lost his license for 45 days, but avoided any jail time or financial penalty.

Docket No. 0708-CR-001873

Client was charged with Assault and Battery on a Police Officer and Disorderly Conduct. The client was arrested at a Boston College Football game after Police witnessed him knock over a portable bathroom. When officers approached the client after witnessing him vandalize the portable bathroom, the client allegedly pushed one of the officers to the ground. Attorney Russell was able to convince prosecution to allow the client to write a letter of apology to the officer whom he assaulted, and serve community service, in exchange for having the case dismissed.

Docket No. 0708-CR-002047

Client was charged with Drug Possession. The client was observed by Police Officers talking on his cell phone and walking up and down a street. The client subsequently met up with another male, and the two individuals got into a car and drove away. Officers followed. Officers indicated in their report that they had made prior arrests in the area, and as such, had reason to believe a drug deal may be in progress. After witnessing the client exit the vehicle, Officers confronted the client and asked how he had come to be where he was. After alleged inconsistent statements, the client was searched and Officers discovered illegal drugs on his person. Client was arrested. Attorney Russell was able to limit the client’s punishment to probation, with random urine tests.

The client was charged with Assault and Battery. Police responded to a call at the client’s home. The client’s girlfriend claimed the two of them were arguing when the client grabbed her throat and began choking her. The client was arrested. The client did not agree with his girlfriend’s account of events and retained Attorney Russell. Team Russell took the case in front of a jury and was able to have the case dismissed.

The client was charged with Assault and Battery. Police responded to a disturbance call at the client’s home. Upon arrival, Officers spoke with the client’s girlfriend who claimed to have been struck by the client in the course of an argument they were having. Due to the girlfriend’s testimony, the client was arrested. Using his experience at the District Attorney’s Office, Attorney Russell was able to negotiate with the prosecutor to have the case dismissed.

Docket No. 0807-CR-005615

The client was charged with stealing paint from a worksite. Officers were called on scene when the owner of a construction site allegedly witnessed the client loading paint cans into his car. The owner of the site confronted the client, who allegedly refused to give the paint back. When officers questioned the client at the site, he told them he had been given permission to take the paint by a third party. The client was arrested. Attorney Russell was able to determine that the incident was the result of a misunderstanding between the client and 3 rd party, and as a result, was able to have the case dismissed.

Docket No. 0807-CR-000925

The client was charged with three counts of Assault and Battery. The client allegedly beat his girlfriend of 7 years with a 2×4 until he was restrained. The client was arrested. Attorney Russell read the police report, and after conducting an interview with the client determined that the police report may have been falsified. Upon further inquiry, Attorney Russell discovered that the alleged victim had no visible injuries after supposedly having been beaten repeatedly with a 2×4. Team Russell took the case to trial where they were able to establish falsified charges, and have the case dismissed outright.

Docket No. 0707-CR-001917

The client was charged with Possession of Drugs. Officers received a call from the client’s father telling them his son’s location. The client had outstanding warrants. Officers arrived on the scene and encountered the client sitting in a car. The officers confronted the client, and given his outstanding warrants, arrested him. On his person, Officers discovered illegal narcotics. Despite the outstanding warrants, and the new drug charges, Attorney Russell was able to limit the client’s punishment to probation. The client served no jail time and the case was ultimately dismissed.

The client was charged with Destruction of Property, Assault and Battery on a Police Officer and Threatening to Commit a Crime. The client allegedly showed up at an ex’s home drunk, and started kicking the door trying to get into the home. When Police responded, the client was allegedly aggressive towards the officers, pushing one of them to the ground. The client was immediately arrested. Attorney Russell was able to speak with the judge and prosecutor in order to secure probation for the client. Despite his attack on a Police Officer, the client served no jail time and the case was eventually dismissed.

Docket No. 0708-CR-002045

The client was charged with Possession of Drugs. Officers allegedly witnessed someone get into the client’s vehicle for a short time and then exit. The client’s vehicle drove away and officers proceeded to follow assuming a drug deal had taken place. Upon stopping the vehicle, Officers discovered drugs in the vehicle, and arrested the client. Officers found two different types of drugs, leading to two different charges. Attorney Russell was able to have the first charge dismissed outright. Using his connections in the District Attorney’s Office, and his 10 years of experience as a Prosecutor, Attorney Russell was able to continue the second charge for 14 months, after which it was dismissed.

Docket No. 0807-CR-003983

The client was charged with Destruction of Property and Assault and Battery. Police Officers were called to the suspect’s house for a domestic disturbance call. Upon their arrival, the victim stated that her son, the client, had allegedly pushed her and broken some of the furniture in the home during an argument the two of them were having. The client did not deny this, and was arrested. Attorney Russell was able to secure community service for the client, after which, the case was dismissed. The client was able to avoid a possible two and a half year jail sentence.

Docket No. 0807-CR-002715

The client was charged with Use of a Motor Vehicle without Authority and Failing to Stop for a Police Officer. The client allegedly ran a stop sign and then failed to stop for the officer that attempted to pull him over. When the client finally did stop, it was discovered that the car he was driving was a rental and not under his name. The client was arrested. Despite the client leading police on a short high-speed chase, Attorney Russell was able to get the charges against him dismissed in exchange for 6 months of probation. The client served no jail time.

Docket No. 0607-CR-007612

The Client was charged with Destruction of Property. The client’s girlfriend called the police after she and the client allegedly had a verbal argument. She alleged that the client was extremely angry and in the process of leaving their home, flipped over her stereo system and dented her car. Officer’s located and arrested the client based on this testimony. The case ended up going to trial where Attorney Russell was able to get the charges dismissed.

Docket No. 0707-CR-000727

Client was charged with Possession of Drugs and Resisting Arrest. Officers allegedly observed the client get into a car and drive around for several minutes. The client then exited the car as it drove off. Officers approached the client and after performing a preliminary search, allegedly discovered narcotics on the client. Client was arrested. Attorney Russell was able to keep the client out of jail, and negotiated with the court to grant the client probation. The client was subject to random urine exams but suffered no other penalties.

Client was arrested for having outstanding warrants, after being pulled over by officers for having an expired license and registration. Attorney Russell worked quickly to avoid any serious penalties for his client. Team Russell was able to secure 30 hours of community service for the client, instead of him having to pay any fines or spend time in jail.

Client was pulled over for allegedly running a stop sign. Upon further inquiry, officers discovered that the client was driving with a suspended license, and was on active probation. Client was arrested. Despite the client’s predicament, Attorney Russell was able to have the case dismissed outright, with the client only having to log 10 hours of community service.

Docket No. 0607-CR-008398

Client was charged with Assault and Battery and Destruction of Property. Officers responded to victim’s home. The victim claimed his daughter kicked him in the head and “trashed” the apartment. Client was subsequently located and arrested. Attorney Russell was able to formulate a deal with the prosecutor to place the client on probation for 6 months and avoid any serious penalties.

Client was charged with Driving with a Suspended License and Registration, and Drug Possession. Officers first stopped the client’s car for a suspended registration and upon further inquiry discovered drugs in the car. The client also had several outstanding warrants against him. The client was subsequently arrested. Despite the overwhelming evidence against the client, Attorney Russell was able to use his connections with the District Attorney’s Office to have the client placed on probation, and ultimately have the case dismissed.

Docket No. 0807-CR-001989

Client was charged with Attempting to Commit Insurance Fraud. The client was allegedly involved in a car accident after which the insurance company claimed fraud. A report issued by the Insurance Fraud Bureau claimed the client, and others involved in the alleged accident, had differing stories of what occurred. Attorney Russell was able to have the case dismissed upon the client paying back some money he received from the insurance company. The client was able to avoid a possible 5-year jail sentence.

Docket No. 0707-CR-001930

Client was charged with Possession of Drugs with the Intent to Distribute, Possessing Drugs within a school zone and Trespassing. Police Officers alleged witnessing the client at an apartment complex known to be a distribution ground for illegal drugs. Upon the officer’s arrival at the complex, they allegedly witnessed the client interacting with several other individuals suspected to be drug dealers. Upon seeing the police, the client allegedly yelled out obscenities and ran away from them, pulling up his pants, indicating to the police he was carrying a concealed weapon. Officers caught up with the client and arrested him. On his person they found illegal drugs. No weapon was found. Through a carefully crafted legal strategy, Attorney Russell was able to dismiss all the charges against the defendant in exchange for the defendant being placed on probation and having to serve 50 hours of community service. The defendant was able to completely avoid jail time.

Docket No. 0607-CR-007791

Client was charged with Receiving Stolen Property. Client was a high school student. Client was given a teacher’s stolen phone by a classmate. The classmate admitted to the initial theft. The classmate also informed school officials of having given the phone to the client. Attorney Russell was able to convince the court to have the case dismissed in exchange for the client paying to replace the phone.

Docket No. 0602-CR-005891

The client was charged with Stealing and Forging Checks. The client was alleged to have cashed several forged checks at various banks in the Boston area. Both charges exposed the client to a maximum 15-year state prison sentence. Attorney Russell’s defense limited the client’s punishment to probation, and having to pay back some of the money from the forged checks. The client served no jail time.

Docket No. 0707-CR-004821

The client was charged with Carrying a Loaded Firearm Without a License, Drug Possession, Failing to Stop at a Stop Sign and Failing to Signal while making a turn. Police Officers alleged they witnessed the client driving down a public road with a cracked windshield. They also alleged they witnessed the client run a stop sign and fail to signal when making a turn. The officers stopped the client for these alleged offenses and proceeded to search the client, and the vehicle based on the fact that the client appeared nervous. Officers discovered drugs and a loaded gun in the car and subsequently arrested the client. Through a careful analysis of the legal precedents having to do with unlawful searches stemming from police asking drivers to exit their vehicles, Attorney Russell filed a motion with the court to suppress the evidence found in the client’s car, including the gun and drugs. The court granted the motion, and as a result, the prosecution no longer had a case, and the matter was dismissed.

Docket No. 0707-CR-001368

Client was charged with Driving with a Suspended License, Possession of Drugs and Turning the wrong way on a one-way street. Officers stopped client’s vehicle after allegedly witnessing the vehicle traveling the wrong way down a one-way street. After further inquiry, officers discovered the client was driving with a suspended license. The officers proceeded to arrest the client, and perform a search of the vehicle, upon which they discovered illegal drugs. Despite the evidence against the client, Attorney Russell spoke with the prosecution and managed to continue the case without a finding, eventually getting the case dismissed. Attorney Russell’s extensive connections with the District Attorney’s Office provided him with the ability to achieve a successful result in the case.

Docket No. 0707-CR-000562

Client was charged with Driving with a Suspended License and Running a Red Light. Officers allegedly witnessed the client run through a red light and proceeded to pull his car over. Upon running the client’s driver’s license, the officers discovered the client was driving with a suspended license and had several outstanding warrants against him. The client was subsequently arrested. Attorney Russell was able to negotiate with the Assistant District Attorney to get the case dismissed, despite the client having a prior record.

Docket No. 0607-CR-007792

Client was charged with shoplifting. Store cameras at Stop & Shop recorded the client filling a bag with items from the store and subsequently leaving the bag in the corner of the store. The client then returned soon after and allegedly attempted to leave the store with the bag of items. Attorney Russell was able to have his client avoid the $250 fine involved, and instead, negotiated the penalty down to an order stating the client had to stay away from Stop & Shop.

Docket No. 0607-CR-005070

The client was charged with possession of drugs. Officers allegedly observed the client’s car parked on a public way. Subsequently, another car pulled up to the client’s car and officers observed the client get in and shortly after, out, of the second car. Officers followed both cars as they left, and proceeded to pull over the client’s car. Officers discovered an 80mg pill of Oxycontin in the client’s car and arrested the client. Despite the client having a prior record, Attorney Russell was able to negotiate with the court to allow the client to pay a small fine and do 30 hours of community service, after which the case was dismissed.

Docket No. 0707-CR-001909

The client was charged with possession of drugs. Police responded to a call at the client’s homes indicating that drugs had been found. Upon arrival, police were made aware of the fact that the client allegedly possessed an amount of marijuana. Client was arrested. Attorney Russell was able to have his client avoid the potential 6 months in prison and $500 fine by speaking with the prosecutor and negotiating the punishment down to 20 hours of community service. Client finished the community service and the case was dismissed.

Client was charged with Operating Under the Influence of alcohol, Driving to Endanger and Failing to stop for a Police Officer. Police Officers allegedly observed the client’s car run several red lights. As they attempted to pull her over, client accelerated to speeds doubling the posted speed limit. Client engaged police in a car chase before she finally pulled over. Officers attempted to administer a field sobriety test, however the client was unable to successfully complete it. Client was arrested. Despite the overwhelming facts against the client, Attorney Russell was able to dismiss all the charges in exchange for the client paying a small fine and entering into an alcohol abuse program.

Docket No. 0707-CR-001367

Client was charged with Assault and Battery. Police Officers allege that they witnessed a group of people break into a fight, resulting in the client punching another member of the group in the face. Client was arrested and charged with Assault and Battery on the victim. Attorney Russell used his experience at the District Attorney’s office to negotiate with prosecutors and limit the client’s punishment to probation only.

Docket No. 0807-CR-001149

Client was charged with Assault and Battery on a Police Officer and Resisting Arrest. The arresting officer claimed he saw the client engaged in an argument with another individual on the street. When the officer approached the situation, the client apparently was very emotional and refused to cooperate with the officer. The client allegedly bumped into the officer and was immediately arrested. After analyzing the specific facts of the situation, Attorney Russell was able to get the Assault and Battery charge dismissed, and the resisting arrest charge continued in exchange for the client doing 10 hours of community service.

Docket No. 0707-CR-000541

The client was charged with possession of drugs. Officers alleged witnessing the client meeting with another individual on a public street for what they assumed to be a drug deal. The client was then seen returning to a vehicle occupied by 2 other individuals, and driving off. Officers stopped the car after allegedly witnessing the client throw something out the window. Officers believed the client was discarding evidence. After searching the vehicle, officers found a syringe filled with illegal narcotics in the seat where the client was sitting, and arrested the client. Attorney Russell immediately filed a motion with the court to suppress evidence gathered by the police. The motion was granted and the prosecution was forced to dismiss the case.

Docket No. 0708-CR-002044

Client was charged with Possession of drugs with intent to Distribute, Distribution of Drugs and Drug Violation within 1000 feet of a school zone. Police officers allegedly observed third parties entering the client’s car for a short period of time while it was parked on the street. After following up with the third party, and finding illegal substances in the car, the client’s car was pulled over and the client was arrested. After meeting with prosecutors, Attorney Russell was able to negotiate the charges down to straight possession, getting all other charges dismissed.

Client had prior criminal record. Client was found to have violated probation by not attending and completing a substance abuse program. Client also failed to report to probation officer after not attending the substance abuse program. Attorney Russell was able to work closely with the client’s parole officer, and at a pre-hearing conference was able to negotiate a deal limiting punishment for the violation.

Docket No. 0607-CR-006714

Client was charged with Assault and Battery, Assault with a Dangerous Weapon and Resisting Arrest. Police responded to a call where an alleged disturbance had occurred. The wife of the client alleged her husband had pushed her against a wall and held scissors to her neck. Upon arrival, police encountered the client who allegedly refused to cooperate with the officer’s requests. The client was eventually arrested and charged. Despite the client’s prior criminal record, Attorney Russell was able to continue the case and have it dismissed upon the client’s completion of 60 hours of community service.

Client was charged with Receiving Stolen Property. Officers spoke with a witness that allegedly witnessed the client walk into a backyard while his friend walked up and down the street in front of the house, and then exit holding a white bag filled with something. After frisking the client, the officers took him into custody. Attorney Russell promptly made a motion with the court, and had the case dismissed due to a lack of jurisdiction over the defendant.

Docket No. 0708-CR-002155

Client was charged with Disorderly Conduct, Assault and Battery on a Police Officer and Resisting Arrest. Police Officers allegedly observed the client outside of a bar, having a heated encounter with two other men. After several attempts to diffuse the situation, the officers claim the client attacked them with his fists, swinging at them and striking one of the officers. Despite the behavior of the defendant towards the officer, Attorney Russell was able to have the disorderly conduct and Assault and Battery charges removed in exchange for a letter of apology and 20 hours of community service. Through his negotiations with the prosecutor, Attorney Russell was also able to get the resisting arrest charge dismissed.

Client was charged with Assault and Battery. Police Officers responded to a call alleging a disturbance in someone’s home, where upon arrival, they separated the two parties involved. Officers claim the client had picked a fight with the victim by stepping on his foot and striking him repeatedly in the face. From his extensive background as a prosecutor, Attorney Russell was able to meet with the prosecution during pre trial hearings and have the case dismissed outright.

Client was charged with Assault and Battery and Assault and Battery with a Dangerous Weapon. Officers responded to a radio call for an assault and battery in progress. Upon arrival they witnessed the victim bleeding from his neck. Officers spoke with the client’s mother who informed them her son was the one who allegedly caused the victim’s injuries. Officers arrested the client. Despite client’s extensive prior criminal record, Attorney Russell was able to reduce the charges from possible jail time to 15 hours of community service.

Client was charged with two counts of Assault and Battery with a Dangerous Weapon. Police arrived on the scene and were taken to the client’s house by the alleged victim, who claimed the client had struck her and her friend with a bottle. Upon arrival at the client’s home, and positive identification of the client by the victim, the client was arrested. Attorney Russell appointed his own investigator to determine what actually happened during the incident in question. Attorney Russell and his team also made several motions on behalf of the client including the suppression of evidence and a motion for a required finding of not guilty. As a result of a carefully crafted legal strategy, Attorney Russell was able to get all charges dismissed.

Client was charged with Operating Under the Influence of alcohol (OUI) and speeding. A police officer allegedly observed the client speeding down a public road and proceeded to pull her vehicle over. The officer administered several tests, which the client allegedly failed, to determine whether client was under the influence of alcohol. Client was subsequently arrested. Facing possible imprisonment, client retained Attorney Russell. Attorney Russell was able to continue the case without a finding resulting in the client having to serve no jail time.

Brookline District Court

Docket No. 0609-JV-000054

Client was a juvenile charged with Disorderly Conduct. Officers noticed a large group of people blocking a public street. After police officers repeatedly told the crowd to disperse, the client allegedly refused to comply, and as a result, was taken into custody. Attorney Russell worked swiftly to avoid the six-month jail/house of correction sentence and the client was granted probation.

Docket No. 1008 CR 0624

Client, a young man, was charged with operating a motor vehicle under the influence of alcohol and with a lesser traffic violation. Officers pulled over the client around 2 a.m. last summer and gave him a series of field sobriety tests.  Client performed the alphabet test, the nine step walk and turn test, and the one-leg stand test, which the police say he failed.  Police alleged he crossed yellow lines, squealed his tires, had bloodshot eyes, and was unsteady on his feet.  After being handcuffed, arrested, and brought to the police station, he refused to take a breathalyzer test and had his license suspended.  After arguing motions to dismiss and suppress evidence, attorney Russell brought the case to trial and vigorously countered the prosecutor’s arguments. On cross examination attorney Russell took apart the officers’ accounting of the client’s field sobriety test and persuaded the court that he wasn’t intoxicated at all.  Client was found not guilty.

Result: Verdict of Not Guilty.

Client, who was not a U.S. citizen, was charged with two felony counts of assault and battery by means of a dangerous weapon. Officers were called to the scene and were informed that Client struck the victim in the head with a bottle. After speaking with eyewitnesses and observing a contusion behind the victim’s ear, Officers arrested Client. Pre-trial, Attorney Russell files several motions in limine, asking the judge to exclude from evidence (1) prior bad acts; and (2) medical records. Attorney Russell also filed a persuasive motion for dismissal of all charges. Attorney Russell successfully convinced the court to dismiss all charges. Federal government put ICE detainer on Client after he was charged with these two counts and Attorney Russell was able to significantly help him due to the dismissal of the case.
Result: Case Dismissed.

Client, who was not a U.S. citizen, allegedly struck the victim in the head with a beer bottle, causing a large laceration to the back of the victim’s neck. On arrival, Officers observed the victim bleeding profusely from the neck and requested Boston EMS to respond. Victim was rushed to hospital. Client was placed under arrest after witnesses, including Client’s own mother, indicated that Client was the suspect. Client was charged with assault and battery and assault and battery by means of dangerous weapon (a felony). Client faced potential state prison time and/or house-of-correction time, as well as immigration consequences. Attorney Russell conducted an extensive investigation and filed motions arguing that Client acted in self-defense. Attorney Russell’s argument convinced the District Attorney’s office and the court to dismiss the case.
Result: Case Dismissed.

Client was charged with domestic assault and battery in violation of a restraining order for allegedly striking the victim in the face during a verbal altercation. Several witnesses were interviewed by the Officers at the scene and the victim’s story was confirmed. Attorney Russell filed several motions with the court and was able to successfully negotiate with the alleged victim’s attorney and the district attorney until an agreement was reached. An “accord and satisfaction” was filed with the court and all of the charges were dismissed.

Client was charged with numerous moving motor vehicle infractions and the Registry of Motor Vehicles (“RMV”) was trying to suspend Client’s license for significant amount of time. Attorney Russell, having represented the RMV as an Assistant Attorney General, represented his Client before the RMV Appeals Board and was able to convince the Board to reinstate Client’s license.

Client allegedly threw her coffee mug at her roommate, who was also an ex-boyfriend, during a heated argument. Police were called to the apartment and Client was arrested for assault and battery by means of a dangerous weapon, which is a felony. Client was a foreign student at a prestigious college in this country on a student visa and, due to this incident, faced immigration issues as well as sanctions from her college. After extensive negotiations with the district attorney, Attorney Russell was able to convince the Commonwealth to dismiss the case outright, therefore saving his client from any further disciplinary action from her college.

Client was charged with negligent operation of motor vehicle. An officer alleged that he clocked the Client’s vehicle traveling at 110 mph. As a result of this charge, Client was facing a year-long suspension of his license. Within days of the incident, Attorney Russell filed motions with the court, including a Motion to Dismiss, and convinced court to dismiss the case, saving the client’s license from being suspended.

Client charged with drug offenses and was arrested on an active default warrant. Police placed Client in the back of the cruiser and transported him for booking. When they instructed him to exit the car they observed a small plastic bag containing what appeared to be crack cocaine on the cruiser floor. Police claimed that they had checked the cruiser at the start of the shift and observed the back seat and floor to be free of any objects. Client faced potential house-of-correction time and immigration consequences. Attorney Russell succeeded in convincing the judge-over the prosecutor’s objection and despite the evidence against the Client-to dismiss all of the drug charges as well as convincing the court that the warrant was invalid and never should have been issued.
Result: Case Dismissed and Warrant Invalidated

Client was an eighteen year-old senior in high school and college bound. Client was charged with resisting arrest and assault and battery. Client allegedly shoved the victim against a wall and put a pair of scissors to her neck. Upon arriving to the scene of the alleged incident, police observed that the victim had minor lacerations to her arms. Police placed client under arrest and Client became combative. Client refused to obey police and called them obscene names. As a result of this incident, Client faced expulsion from his high school. After extensive investigation, Attorney Russell was able to convince the District Attorney’s office to dismiss the case, thereby allowing him to stay in school.

Client was arrested at Gillette Stadium and charged with disorderly conduct and assault and battery by means of a dangerous weapon. Client had too much to drink while at a game and spit at the opposing team’s players, which allegedly landed on a police officer. Police arrested him by descending upon the Client and yanking him out of his seat. Client, an avid fan and season ticket holder, ran the risk of losing his privileges to attend games at Gillette Stadium. He also was in jeopardy of losing his job. Attorney Russell successfully convinced the police involved in the incident and the prosecutor to dismiss the case with no repercussions for Client’s record.

Client, a 20 year-old college student attending a prestigious university, was charged with possession of illegal substance and drinking under the age of 21. Client was summonsed to Clerk Magistrate Hearing to determine whether a criminal complaint would be issued, which would result in Client having entry on his record. Attorney Russell successfully advocated for Client and convinced the prosecutor to recommend pre-trail probation for Client. The judge agreed. As a result of Attorney Russell’s zealous representation before the Clerk Magistrate, Client did not have to admit to committing any crime and instead needed only to continue with his schooling and stay out of further trouble.

Client was charged with threats and making annoying phone calls. Client was arraigned in court and was about to admit to the crime. However, client fired her old lawyer and hired Attorney Russell. Immediately after being hired by Client, Attorney Russell conducted his own investigation and pulled all of the complaining witness’s phone records as well as all of Client’s records. Attorney Russell was able to prove to the Government and the judge that the victim was not telling the truth and that the allegations were completely false. The prosecutor thereafter agreed to dismiss all the charges. As a result of Attorney Russell’s victorious representation, Client was able to move to North Carolina without being on probation or subject to oversight by the probation department.

Client, an honor roll high school student, was pulled over while driving a car without an adult present. Client only had her learner’s permit and therefore was required to be with an adult when driving a motor vehicle at all times. Client was summonsed for a Clerk Magistrate Hearing. Attorney Russell successfully convinced the clerk magistrate not to issue any complaint against the Client, thereby saving her driving record and auto insurance.

Client was National Honor’s Society high school student who was caught selling drugs to undercover detective on three independent occasions within school zones. Client was charged with numerous drug distributions charges within school zone. Client was facing significant minimum mandatory jail time. Attorney Russell, after extensive investigation, was able to convince the government to reduce all charges to one count of possession. Client received continuation without finding. The case was ultimately dismissed, preserving Client’s record and allowing her to pursue college.
